General Terms and Conditions

  1. Information on how to register and information on www.naturesfresh.co.nz forms part of the terms and conditions of this promotion. By collecting Nature’s Fresh Points in the 2009 Nature’s Fresh “Win Cool Prizes to Keep Kids Active” Promotion (the Promotion”) participants accept and agree to be bound by these terms and conditions.
  2. Participation in the Promotion is open to all residents in New Zealand via online registration at www.naturesfresh.co.nz. Employees of Goodman Fielder New Zealand Limited ("the Promoter") and any agencies associated with these promotions and their immediate families are ineligible to participate in the promotion. Persons under the age of 18 must have the consent of their parents/legal guardians. 
  3. The Promoter takes no responsibility for lost, damaged, misdirected, late or illegible entries.
  4. The Promoter and/or internet service providers take no responsibility for incorrect or inaccurate transcription of information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, failures of any computer equipment, software, inability to access telecommunications network services, congestion or any other error or malfunction in relation to the Promotion, including but not limited to misdirected, late, delayed or failed requests for registration.
  5. Prize claims strictly limited to the first 4,620 prizes successfully claimed, where these prizes comprise:

  6. Total prize pool value is  $ 92,193.80  (based on recommended retail values)
  7. The Promoter may change, at any time and without prior notice, these terms and conditions and/or the points schedule relating to prize claims. The Promoter may make changes even if it has the effect of reducing or extinguishing the number or value of, or the period for expiry of, any existing or future Nature’s Fresh points claims. The Promoter will attempt to notify registered participants of any changes.
  8. The Promoter reserves the right to suspend or terminate the Promotion at any time without prior notice.
  9. The Promoter will collect and hold personal information provided by each registrant in the Promotion for the purposes of verifying prize claimants’ identities.  All personal information provided by registrants will be held by Goodman Fielder New Zealand Limited. Participants have the right to access, update and correct their personal information, and may do so by logging onto www.naturesfresh.co.nz and clicking on the My Details button.

Collecting Nature’s Fresh Points

  1. The Promotion commences on 13th July 2009 and ends on 4th October 2009 ("Promotion Period").  Nature’s Fresh Points may only be collected during the Promotion Period.
  2. To collect Nature’s Fresh Points participants must do the following:
    1. Purchase any specially marked promotional packet of Nature’s Fresh product - a unique code can be found on the back of each packet.  Each unique code from a specially marked promotional pack = 1 Nature’s Fresh Point.
    2. Visit www.naturesfresh.co.nz and register in the Promotion by following the online entry instructions on the website.  You only need to register once. Each registered user must have a unique email address.  To start accumulating Nature’s Fresh Points, registered entrants must enter their first unique code in the space indicated, along with their contact details and login details. Each unique code can be submitted only once. Unique codes which have been entered previously or are not otherwise verifiable will be invalid and will not count towards an entrant’s total points. Successful Point entries will receive a pop-up confirmation and e-mail message indicating that their entry has been successfully registered and that the unique code used has not previously been entered and is not otherwise valid.
  3. To accumulate additional Nature’s Fresh Points during the Promotion Period, registered entrants must buy more specially marked promotional packets of Nature’s Fresh products and enter their unique codes at www.naturesfresh.co.nz .
  4.  Nature’s Fresh Points must be redeemed (i.e. submitted online) by a participant no later than 5pm on 4th October 2009 ("Redemption Date").  Nature’s Fresh Points cannot be used for any purpose after the Redemption Date and any Nature’s Fresh Points remaining in a registered participant’s account after the Redemption Date will automatically expire.

Main Prize Draw

  1. The Major Prize will be drawn on Friday 9th October 2009 from all valid entries received
  2. Each time a registered entrant successfully enters a unique code in the Promotion, the entrant will also automatically receive an entry into the Main Prize draw.

    The Main Prize consists of:

    7 Nights accommodation at a Bach of your Choice from www.bachcare.co.nz to a maximum value of $350.00 per night. Bach selection is subject to availability (and excludes 22nd December 2009 to 11th January 2010.) The winner must agree to Bachcare’s Standard Terms and Conditions. Bachcare Bond is the responsibility of the Winner.  Travel to and from the Holiday House chosen and all other incidental expenses are the sole responsibility of the Winner. Beach House Prize must be used by 31 March 2011.

    The sports equipment component of the prize package will be sent to the Major Prize Winners’ residential street address. Brands selected in relation to sports equipment components will depend on gender of the Major Prize Winner. Prizes will be sent within 21 days of the close of the Promotion.
  3. Entrants are identified by the email address used to submit the entry. The major prize will be awarded to the holder of the email address from which that entry was submitted. The promoter takes no responsibility for disputes arising as a result of entries submitted by entrants using an email address belonging to any other person.
  4. The winner of the Major prize will be notified in accordance with details available to the Promoter and the contact details supplied by the entrant. The winner will be emailed to the email address from which the email entry was received or contacted on the telephone number provided. The prize winner will also have their name and city published for 3 months on www.naturesfresh.co.nz.
  5.  If the Promoter is unable to contact Main Prize winner after 4 weeks following the original date, having made reasonable efforts to do so, that winners entry will be declared invalid and the Promoter reserves the right in its absolute discretion to randomly draw a new winner from eligible participants on the same Terms and Conditions as the original draw. The Process will be followed until a winner is found.
  6. By accepting a prize you agree to be available for reasonable publicity and promotional purposes without compensation, including photographs and interviews.  The Winner acknowledges that their personnel details including photographs may be published in newspapers and on the internet.
  7. The Promoter, its associated agencies and companies, and Bachcare Ltd shall not be liable in any way (including, without limitation, in negligence) for any loss or damage whatsoever suffered (including, without limitation, indirect or consequential loss) or for any loss or damage or personal injury suffered or sustained in connection with this prize competition, the prizes or using any prize, except any liability that cannot be excluded by law.

Redemption of prizes using Nature’s Fresh Points

  1. To use Nature’s Fresh Points to claim prizes, registered entrants must visit www.naturesfresh.co.nz and correctly complete the Nature’s Fresh online prize claim form.  Claims will only be valid where registered entrant has sufficient Nature’s Fresh Points to qualify for the prize selected. The minimum number of Nature’s Fresh Points required in respect of the various prizes on offer are set out below:

  2. Provided a registered entrant has accrued sufficient Nature’s Fresh Points to make valid prize claims, there is no limit on the maximum claims an entrant can submit for Level 1 and Level 2 Prizes – Level 3 prizes are strictly limited to 2 prizes per registered entrant and/or Delivery Address until the maximum prize pool of 4,620 prizes as detailed in clause 5 has been exhausted, as long as:
    1. the entrant is over the age of 18 years (proof of age may be required) or has a parent or guardian’s permission if he/she is a minor; AND
    2. the on-line prize claim form is correctly completed.
    If there is no more stock of the particular prize claimed, a pop-up message will advise the entrant of this fact and advise him/her to select an alternative prize.
  3. Nature’s Fresh  Points will be deducted:
    1. Following a successfully submitted valid prize claim. The number of Nature’s Fresh Points corresponding to the prize redeemed will be deducted from the participant's Nature’s Fresh  Points account, OR
    2. If any Nature’s Fresh Points are awarded and recorded in error.
  4. Registered entrants must allow 14 working days for delivery of validly claimed prizes following confirmation of a successfully received online prize claim. Prizes will be delivered to the street address supplied by the entrant during registration. Prizes can only be delivered to street addresses and will not be delivered to P. O. Box Addresses.
  5. Nature’s Fresh Points are not redeemable for cash or transferable.  Nature’s Fresh Points have no cash or monetary value.
  6. Participants are advised to retain their Nature’s Fresh Unique Codes as obtained from specially marked packs as proof of participation and identity.
  7. The Promoter and its associated agencies and companies shall not be liable in any way (including, without limitation, in negligence) for any loss or damage whatsoever suffered (including, without limitation, indirect or consequential loss) or for any loss or damage or personal injury suffered or sustained in connection with the Promotion, prizes awarded and use of those prizes, except any liability that cannot be excluded by law. Any liability the Promoter may have in respect of prizes to claimants under legislation which cannot be excluded is limited, where permitted, to the re-supply or repair of prizes, whichever the Promoter chooses.
